AN ACT

 

amending title 13, chapter 39, Arizona Revised Statutes, by adding section 13‑4316; relating to forfeiture.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 39, Arizona Revised Statutes, is amended by adding section 13-4316, to read:

START_STATUTE13-4316.  Annual report on forfeited property

A.  On or before December 31, each seizing agency shall submit an annual report that lists all property that was seized and forfeited pursuant to this chapter in the previous year.

B.  The report must identify the property that was seized and the date of the seizure and forfeiture.  If the property was an illegal or controlled substance, the report must include the disposition of the property and, if destroyed, the date of the destruction.

C.  If the seizing agency is a city or town agency, the agency shall submit the report to the city or town council.  If the seizing agency is a county agency, the agency shall submit the report to the county board of supervisors.  If the seizing agency is a state agency, the agency shall submit the report to the governor.
