AN ACT

 

amending sections 28-336 and 28-338, Arizona Revised Statutes; relating to driver licenses.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-336, Arizona Revised Statutes, is amended to read:

START_STATUTE28-336.  REAL ID act; implementation prohibited; exception

Except as otherwise provided in this section, this state shall not participate in the implementation of the REAL ID act of 2005 (P.L. 109-13, division B; 119 Stat. 302).  The department shall not implement the REAL ID act of 2005 and shall report to the governor and the legislature any attempt by agencies or agents of the United States department of homeland security to secure the implementation of the REAL ID act of 2005 through the operations of the United States department of homeland security, except that if a driver license applicant requests a driver license that is compliant with the REAL ID act of 2005, the department must issue the applicant a driver license that is compliant with the REAL ID act of 2005. Sec. 2.  Section 28-338, Arizona Revised Statutes, is amended to read:

START_STATUTE28-338.  Enhanced driver license prohibition; exception

Except as otherwise provided in this section, this state shall not participate in the implementation of an enhanced driver license program to satisfy the requirements of the federal western hemisphere travel initiative or the REAL ID act of 2005 (P.L. 109‑13, division B; 119 Stat. 302).  The department shall not implement an enhanced driver license program and shall report to the governor and the legislature any attempt by agencies or agents of the United States department of homeland security to secure the implementation of an enhanced driver license program through the operations of the United States department of homeland security, except that if a driver license applicant requests a driver license that is compliant with the REAL ID act of 2005, the department must issue the applicant a driver license that is compliant with the REAL ID act of 2005.
