AN ACT
Amending title 37, chapter 4, Arizona Revised Statutes, by adding article 2; relating to government acquisition of private real property.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 37, chapter 4, Arizona Revised Statutes, is amended by adding article 2, to read:
ARTICLE 2. PRIVATE LAND ACQUISITION
37-821. Definition of government entity
In this article, unless the context otherwise requires, "government entity" means this state, a county, city or town or any agency or instrumentality of this state or a county, city or town.
37-822. Finding of statewide concern; state preemption
The lack of private property in this state that is available for homeownership, development, industry or business hinders the economy of this state and of local communities in this state. The ownership of real property by a government entity that causes the removal of real property from the tax rolls, thereby reducing the tax base of the local community in which the property is located, is an issue of statewide concern and is not subject to further regulation by a county, city, town or other political subdivision of this state.
37-823. Government acquisition of private real property; sale of government real property
If a government entity purchases, acquires an option to purchase or files an action to condemn privately owned real property, the government entity shall make available for sale to private parties real property that the government entity owns and that has an appraised value equal to the appraised value of the real property acquired.
