Strike lines 32 through 39, insert:

"The director shall establish the maximum allowable rates for all towing vehicle classifications used in contractual agreements pursuant to this subsection.  Each maximum allowable rate shall include the base rate for each geographic towing area plus an increase equal to the total percentage adjustment in the year-to-year July combined transportation services index from July 2010 to July 2014 as published by the united states department of transportation bureau of transportation statistics.  The super heavy duty towing vehicle maximum allowable rate shall be twice the base rate for the heavy duty towing vehicle.

F.  Beginning from and after December 31, 2015, The maximum allowable towing and storage service rates are subject to a contractual agreement entered into pursuant to this subsection, and on december 31 of each subsequent year, the department of public safety must adjust the towing and storage service fee charged by an amount equal to the percentage change in the combined transportation services index from year to year as published by the united states department of transportation bureau of transportation statistics or two percent, whichever is greater.  The maximum allowable towing and storage service rates may not be revised below the amounts prescribed in the prior year."

"L.  For the purposes of this section:

1.  "Base rate" means the rate for each towing service type and classification and each storage service fee as determined in contractual agreements existing on July 1, 2014.

2.  "super heavy duty towing vehicle" means a tow vehicle that has all of the following:

(a)  A manufacturer's gross vehicle weight rating in excess of fifty-two thousand pounds.

(b)  A boom that is capable of moving its position to the side of the vehicle to perform recoveries and that has a boom rating of at least forty tons.

(c)  Air brakes that are capable of providing air to the towed vehicle's brakes."
