SENATE AMENDMENTS TO S.B. 1222

Strike everything after the enacting clause and insert:
"Section 1. Title 13, chapter 6, Arizona Revised Statutes, is amended by adding section 13-611, to read:
13-611. Unauthorized plea agreements; charges; deported arrestees
A. If a person is arrested in this state and deported from this country before the disposition of any charges that could result from the arrest, the prosecutor may not dismiss or offer the person a plea offer that dismisses or allows the person to plead to a lesser offense than the original charges that the person was arrested for if the person returns to this country.
B. Any time that the person is not in this country is tolled when calculating the statute of limitations prescribed in section 13‑107."
