AMENDMENT EXPLANATION
Specifies that if a
contract for prison beds awarded under Section 11, Subsection A contains a
minimum inmate requirement, the contract must also contain a requirement that
the contractor refund the appropriate monies to the state department of
corrections if the actual number of inmates is less than the minimum inmate
requirement. Additionally, it subjects a contractor who fails to refund monies
to prosecution for fraud.

requirements;"
Between lines 32 and 33, insert:
"C. If a contract that is awarded pursuant to
subsection A of this section contains a requirement for a minimum number of
inmates, the contract must also contain a requirement for the contractor to refund
monies to the state department of corrections if the actual number of inmates
incarcerated in the private prison is less than the required number of inmates.
A contractor who fails to refund monies to the state department of corrections
may be prosecuted for a violation of section 13‑2108, Arizona Revised
Statutes."
