AN ACT

 

amending Title 15, chapter 1, article 5, Arizona Revised Statutes, by adding section 15-158; relating to school safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 5, Arizona Revised Statutes, is amended by adding section 15-158, to read:

START_STATUTE15-158.  Cellular telephone towers on school property; worker documentation and sign in; civil penalty

A.  If a cellular telephone tower is located on an easement that is granted on property owned or leased by a public school, any person who accesses the easement for the purpose of maintaining, inspecting or servicing that cellular telephone tower shall sign in at the school office and provide government‑issued identification to school office personnel before accessing the easement.

B.  At the request of the principal or head teacher of a school at which an alleged violation of subsection A of this section occurred, The attorney general or the county attorney for the county in which the alleged violation occurred may serve on the employer of a person who is determined to be out of compliance with this section an order requiring compliance with this section and may assess a civil penalty of not more than ten thousand dollars for each violation of subsection A of this section.  The employer of the person is responsible for paying the civil penalty.  All civil penalties collected pursuant to this subsection shall be transferred to the state treasurer for deposit, pursuant to sections 35-146 and 35-147, in the state general fund.
