AN ACT

 

Amending title 20, chapter 4, article 3, Arizona Revised Statutes, by adding section 20‑841.11; amending title 20, chapter 4, article 9, Arizona Revised Statutes, by adding section 20‑1057.16; amending title 20, chapter 6, article 4, Arizona Revised Statutes, by adding section 20‑1376.08; amending title 20, chapter 6, article 5, Arizona Revised Statutes, by adding section 20‑1406.08; relating to health insurance coverage.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 20, chapter 4, article 3, Arizona Revised Statutes, is amended by adding section 20-841.11, to read:

START_STATUTE20-841.11.  Coverage of health care services

All contracts issued, delivered or renewed on or after july 1, 2017 by a corporation in this state must provide coverage for lawful health care services that are provided by a health care provider to a subscriber regardless of the familial relationship of the health care provider to the subscriber if the health care service would be covered were it provided to a subscriber who was not related to the health care provider.  The contract may limit the coverage to those health care providers who are members of the corporation's provider network.END_STATUTE

Sec. 2.  Title 20, chapter 4, article 9, Arizona Revised Statutes, is amended by adding section 20-1057.16, to read:

START_STATUTE20-1057.16.  Coverage of health care services

Any evidence of coverage issued, delivered or renewed on or after july 1, 2017 by a health care services organization in this state must provide coverage for lawful health care services that are provided by a health care provider to an enrollee regardless of the familial relationship of the health care provider to the enrollee if the health care service would be covered were it provided to an enrollee who was not related to the health care provider.  The evidence of coverage may limit the coverage to those health care providers who are members of the health care services organization's provider network.END_STATUTE

Sec. 3.  Title 20, chapter 6, article 4, Arizona Revised Statutes, is amended by adding section 20-1376.08, to read:

START_STATUTE20-1376.08.  Coverage of health care services

All policies issued, delivered or renewed on or after july 1, 2017 by a disability insurer in this state must provide coverage for lawful health care services that are provided by a health care provider to an insured regardless of the familial relationship of the health care provider to the insured if the health care service would be covered were it provided to an insured who was not related to the health care provider.  The policy may limit the coverage to those health care providers who are members of the disability insurer's provider network.END_STATUTE

Sec. 4.  Title 20, chapter 6, article 5, Arizona Revised Statutes, is amended by adding section 20-1406.08, to read:

START_STATUTE20-1406.08.  Coverage of health care services

All policies issued, delivered or renewed on or after july 1, 2017 by a group or blanket disability insurer in this state must provide coverage for lawful health care services that are provided by a health care provider to an insured regardless of the familial relationship of the health care provider to the insured if the health care service would be covered were it provided to an insured who was not related to the health care provider.  The policy may limit the coverage to those health care providers who are members of the insurer's provider network.END_STATUTE
