AN ACT

 

relating to gasoline formulations and the state implementation plan for air quality.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Air quality state implementation plan; waiver; Arizona approved fuels shortage; CARB gasoline

The director of the department of environmental quality shall apply to the United States environmental protection agency for a waiver from certain requirements of the state implementation plan for air quality regarding the use of Arizona clean burning gasoline and Arizona reformulated blendstock for oxygenate blending to allow for the use of California air resources board phase 3 gasoline during times of shortage in the supplies of these approved Arizona fuels.  The implementation of the waiver may be conditioned on the director of the department of environmental quality, after consultation with the director of the Arizona department of agriculture and the associate director of the weights and measures services division, issuing a finding of shortage in the supplies of Arizona clean burning gasoline or Arizona reformulated blendstock for oxygenate blending.
