AN ACT

 

Repealing section 41-3016.27, Arizona Revised Statutes; amending title 41, chapter 27, article 2, Arizona Revised Statutes, by adding section 41‑3024.09; relating to the department of transportation.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Section 41-3016.27, Arizona Revised Statutes, is repealed.

Sec. 2.  Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 41-3024.09, to read:

START_STATUTE41-3024.09.  Department of transportation; termination July 1, 2024

A.  The department of transportation terminates on July 1, 2024.

b.  Title 28 is repealed on January 1, 2025. END_STATUTE

Sec. 3.  Purpose

Pursuant to section 41-2955, subsection B, Arizona Revised Statutes, the legislature continues the department of transportation to:

1.  Design, construct and maintain the state highway system and state routes for the entire state.

2.  Provide for orderly registration and titling of vehicles and licensure of motor vehicle drivers.

3.  Assist and promote the aviation industry in this state.

4.  Provide for orderly registration and licensure of general aviation aircraft.

Sec. 4.  Retroactivity

Sections 1 and 2 of this act are effective retroactively to July 1, 2016.

Sec. 5.  Joint legislative use fuel tax adjustment study committee; membership; duties; report; delayed repeal

A.  The joint legislative use fuel tax adjustment study committee is established consisting of the following members:

1.  Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party.  The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the committee.

2.  Three members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party.  The president of the senate shall designate one of these members to serve as cochairperson of the committee.

3.  The director of the department of transportation or the director's designee.

4.  Two members representing a petroleum marketers association in this state, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.

5.  One member who is a tow truck driver and who is appointed by the president of the senate.

6.  One member who is a licensed heavy duty truck driver and who is appointed by the president of the senate.

7.  One member representing a large fuel wholesaler who is appointed by the speaker of the house of representatives.

8.  One member representing a small fuel wholesaler who is appointed by the speaker of the house of representatives.

B.  The committee shall:

1.  Study the impact of the current use fuel tax structure on industries and commerce in this state, including heavy and light weight commercial vehicles, passenger vehicles, petroleum distributors and petroleum retailers.  The committee shall review potential benefits and potential problems with changing the current two tier fuel tax structure to a one tier use fuel tax structure.

2.  Submit a report regarding the committee's activities and recommendations for administrative or legislative action on or before December 15, 2016 to the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

C.  This section is repealed from and after November 30, 2017.
