PROPOSED

HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2566

Strike everything after the enacting clause and insert:

"Section 1.  Section 44-1604, Arizona Revised Statutes, is amended to read:

START_STATUTE44-1604.  Local ordinances

A.  This article does not supersede any city, town or county ordinance nor does this article prohibit a city, town or county from enacting an ordinance regulating dealers of precious items.  If a city, town or county has an ordinance regulating dealers of precious items, the provisions of this act article and the provisions of that ordinance shall both apply except that an ordinance of a city, town or county which that conflicts with or provides less stringent requirements than are provided in this article shall not be enforceable.

B.  A city, town or county may not impose a fee on any transaction between a dealer and a seller or consignor if the transaction involves the purchase, trade, exchange or receipt of a precious item pursuant to this article. END_STATUTE

Sec. 2.  Title 44, chapter 11, article 3, Arizona Revised Statutes, is amended by adding section 44-1633, to read:

START_STATUTE44-1633.  Transaction fee by local authority prohibited

A city, town or county may not impose a fee on any reportable transaction. END_STATUTE

Sec. 3.  Legislative intent

Pursuant to section 41-1107, Arizona Revised Statutes, it is the legislature's intent to:

1.  Promote a spirit of deregulation and a uniform process and standard within the pawnbroker and precious item dealer industries.

2.  Bar burdensome and likely unconstitutional taxes and fees.

3.  Promote more commerce throughout this state.

4.  Stimulate economic development."
