SENATE AMENDMENTS TO H.B. 2390

Strike everything after the enacting clause and insert:
“Section 1. Civil forfeiture study committee; duties; report; delayed repeal
A. A civil forfeiture study committee is established consisting of the following members:
1. Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party. The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the committee.
2. Three members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party. The president of the senate shall designate one of these members to serve as cochairperson of the committee.
3. One member who is a county sheriff from a county with a population of four hundred thousand or more persons and who is appointed by the president of the senate.
4. One member who is a county sheriff from a county with a population of less than three hundred thousand persons and who is appointed by the speaker of the house of representatives.
5. One member who is affiliated with a statewide policy and research organization that has a background in civil asset forfeiture and who is appointed by the governor.
B. Study committee members are not eligible to receive compensation but are eligible to receive reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.
C. The study committee shall study and analyze statutes, policies, procedures and practices in this state relating to civil forfeiture.
D. The study committee shall submit a report of its findings and recommendations to the governor, the president of the senate and the speaker of the house of representatives on or before December 15, 2016 and shall provide a copy of this report to the secretary of state.
E. This section is repealed from and after December 31, 2016.”
