AN ACT
Appropriating monies to the department of administration.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Appropriation; January 8 memorial; matching monies; review; exemption
A. The following sums are appropriated from the state general fund in each of the following fiscal years to the department of administration for distribution to a nonprofit organization that is exempt from federal income taxation under section 501(c) of the internal revenue code for construction of a January 8 memorial that honors the victims of the January 8, 2011 tragedy in Tucson:
1. In fiscal year 2017-2018, $500,000.
2. In fiscal year 2018-2019, $500,000.
3. In fiscal year 2019-2020, $500,000.
4. In fiscal year 2020-2021, $500,000.
5. In fiscal year 2021-2022, $500,000.
B. Monies from each appropriation made in subsection A of this section may not be distributed in that fiscal year until a matching amount of monies from sources other than this state of gifts, grants and donations has been collected by the nonprofit organization for the January 8 memorial. Before distributing the appropriation each fiscal year, the department of administration shall submit a report of the scope, design, construction progress and estimated cost of the January 8 memorial and a detailed, cumulative accounting of the matching amounts required by this subsection to the joint committee on capital review for its review pursuant to section 41-1252, Arizona Revised Statutes.
C. Pursuant to section 35‑142.01, Arizona Revised Statutes, if the monies appropriated in subsection A of this section are subject to reimbursement in whole or in part from federal monies, the federal monies shall be deposited in the state general fund.
D. The appropriations made in subsection A of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations until June 30, 2023.
Sec. 2. Conditional enactment; notice
A. This act does not become effective unless on or before June 30, 2023 the United States secretary of the interior establishes a January 8 national memorial in Tucson as an affiliated area of the national park system.
B. The director of the Arizona legislative council shall notify in writing the director of the joint legislative budget committee and the director of the department of administration on or before June 30, 2023 either:
1. Of the date on which the condition was met.
2. That the condition was not met.
Sec. 3. Delayed repeal
This act is repealed from and after December 31, 2023.
