AN ACT
Amending title 18, chapter 1, article 1, Arizona Revised Statutes, by adding section 18-106; relating to government information technology.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 18, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 18-106, to read:
18-106. Software acquisition, purchase and development; definitions
A. A budget unit shall do one of the following:
1. Locate and acquire government off-the-shelf software from another budget unit.
2. Purchase commercial off-the-shelf software from a retail provider.
3. If commercial off‑the‑shelf software is not available, purchase any software that is developed by a third party or develop in‑house software for any budget unit to use.
4. If the acquisition, purchase or development of software is not feasible under paragraph 1, 2 or 3 of this subsection, contract with an independent third party for all new software development. The budget unit may use only in‑house staff to modify any current software products on nonlegacy systems.
B. A budget unit may produce and provide to other budget units government off-the-shelf software. Any government off-the-shelf software provided pursuant to this subsection shall be provided without express or implied payment or warranty and without the provision of upgrades or maintenance.
C. For the purposes of this section:
1. "government off-the-shelf software" means government software products that are ready to use and that are created and owned by a budget unit.
2. "Nonlegacy system" means a system that has been developed within the preceding seven years.
