AN ACT
Amending Title 37, chapter 9, article 4, Arizona Revised Statutes, by adding section 37-1391; relating to fire codes.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 37, chapter 9, article 4, Arizona Revised Statutes, is amended by adding section 37-1391, to read:
37-1391. Applicability of fire code requirements for water or fire flow; definition
A. Notwithstanding any other law, in a county with a population of less than five hundred thousand persons, any requirements to provide water or fire flow, or both, for fire protection under a fire code adopted by this state or a municipality, county or fire district of this state do not apply to single‑family residential properties or single‑family residential subdivisions with individual lot dimensions equal to or greater than one‑half acre in size if the current adjacent public water distribution system does not meet the requirements to provide water or fire flow, or both, for fire protection.
B. For the purposes of this section, "adjacent public water distribution system" means a water system that is owned and operated by a political subdivision of this state or a private water company that provides water for sale and delivery to the general public and that has a water distribution main and easement that is contiguous to any portion of the single‑family residential property or single‑family residential subdivision.
