FLOOR AMENDMENT EXPLANATION
The Bradley Amendment provides that the State of Arizona may not submit any waiver or seek permission from the federal government in any form to do either of the following:
1. Allow this state to define essential health benefits for the purposes of health insurance coverage offered in the individual and small group health insurance markets in a manner that would provide fewer health benefits than are provided under the Patient Protection and Affordable Care Act of 2010.
2. Allow a health insurer in the state to consider a person’s pre-existing condition when determining eligibility or continued eligibility for health insurance coverage or calculating the premium rate to be charged for coverage.

"Sec. 25. Federal waiver submission; prohibition
This state may not submit any waiver or seek permission from the federal government in any form to do either of the following:
1. Allow this state to define essential health benefits for the purposes of health insurance coverage offered in the individual and small group health insurance markets in a manner that would provide fewer health benefits than are provided under the Patient Protection and Affordable Care Act of 2010.
2. Allow a health insurer in this state to consider a person's preexisting condition when determining eligibility or continued eligibility for health insurance coverage or calculating the premium rate to be charged for health insurance coverage."
