HB 2156, folic acid information; appropriation – DO PASS

Michael McQueen, M.D. (Neonatology), representing self, testified in favor of HB 2156. He indicated that hospital costs for one child with these birth defects would far exceed the $200,000 appropriation. Folic acid is present in healthy diets, but it is not prevalent in the Atkins diet and others that are sweeping the country. One tablet of folic acid per day is sufficient. Arizona’s relatively new program already shows a 22 percent decrease in these birth defects, and clinical trial data levels indicate that as many as 60 to 70 percent of the birth defects can be prevented.

Pete Wertheim, Legislative Liaison, Arizona Department of Health Services (DHS), related that the DHS budget contains money to provide folic acid tablets, but HB 2156 requests funding for pamphlets and outreach regarding the importance of taking the tablets. In looking at the Children’s Rehabilitative Services Program and the cost for these types of children, one child could easily cost $200,000.
Dr. McQueen related that if it is determined that a child has a birth defect during an ultrasound, whether or not the parent chooses to have an abortion is an individual choice.

Karen Liersh, Arizona Department of Education, advised that the fees for the adult education programs would be $20 to $50 per year starting out and would probably increase over several years. The delivery system is diverse, so allowing the local programs to develop their own fee package is the best way to go, with oversight by ADE. She indicated that measures have been taken to implement Proposition 300 in the adult education programs.

Representative Mark Anderson, Sponsor, advised that the amount of money in the Failing Schools Tutoring Fund is expected to decrease because more students are signing up for tutoring, and a similar bill in the Senate draws from the General Fund, which is the reason for switching the appropriation to the General Fund. He further explained HB 2203. Discussion followed relating to whether or not students who complete the program but still do not read at the appropriate level should be allowed to go on to fourth grade, and the possibility of parents paying a portion of the cost of the remediation program.

Representative Eddie Farnsworth, Sponsor, further explained the S/E amendment to HB 2726. He indicated that a number of cases have occurred nationally. The number of cases is not tracked in Arizona because it is not illegal, so there is no way to prosecute someone because no crime is committed; however, this system is used on a regular basis.

DEMA wants to make sure any money appropriated by the state is not wasted in that this does not guarantee a system that is integrated with the federal system, which would be the best of both worlds.

A portion would be picked up by the General Fund and the county would also pay a portion. The formula is the best representation of what would be fair to all those entities and citizens of the state.

HB 2385. She related that the county’s payment is withheld from its sales tax

This is a continuation of the philosophy the board adopted over the last five years to take more direct responsibility in funding items there is some control over, in particular, local law enforcement, criminal justice-type things, and in exchange, move away from funding items there is no control over whatsoever like the Arizona Health Care Cost Containment System or the Arizona Long-Term Care System. It is consistent with taking over Juvenile Probation last year.

Anthony Rodgers, Director, Arizona Health Care Cost Containment System, spoke in opposition to HB 2498. He said there is a two-year management plan of action to address this issue, and he anticipates breaking even in terms of holding the plans harmless for this particular medical loss period by 2009. He estimated an 18 percent rate increase each year to reach the break-even point. He said if the bill passes, there are a number of conflicting requirements in Title 20 and Title 36 that make it difficult to know who would be responsible for what portions of the new Healthcare Group operated under the Department of Insurance.
