"44-1753. Prescriptions; refills
A. If a patient completes an initial thirty‑day supply of a prescription drug, a pharmacist may dispense up to a ninety‑day supply of that prescription drug if both of the following requirements are met:
1. The total quantity of dosage units dispensed by the pharmacist does not exceed the sum of the dosage units of the remaining refills authorized by the prescriber.
2. The pharmacist is exercising the pharmacist's professional judgment.
B. If the pharmacist is filling a prescription for a prescription drug that was previously filled with a ninety‑day supply, the initial thirty‑day supply limit described in subsection A of this section does not apply.
C. Notwithstanding subsection A of this section, a pharmacist may not exceed the number of dosage units authorized by a prescriber for an initial prescription or subsequent refills if either of the following apply:
1. The prescriber has specified on the prescription that due to medical necessity the pharmacist may not exceed the number of dosage units identified on the prescription.
2. The prescription is for a controlled substance.
D. This section does not require a health care service plan, health insurer, workers' compensation insurance plan, pharmacy benefits manager or any other person or entity, including a state program or state employer, to provide coverage for a prescription drug in a manner inconsistent with a beneficiary's plan benefit."
