Relating to firearms, the Guard and state Militia.
Provisions
1. Subjects a firearm that automatically shoots more than one shot without manual reloading by a single activation of the trigger to federal regulation. (Sec. 1)
2. Removes the cap of 45 years old for citizens who are members of the Militia and who act in concert for the common defense. (Sec. 2)
3. Allows a person who is or has been in the Militia to privately purchase a particularly suited firearm or equipment and use or transport them for all lawful purposes. (Sec. 4)
4. Creates the Program to provide firearms for training in marksmanship skills to citizens and residents who are eligible for service in the Guard. (Sec 3)
5. Requires DEMA to administer the Program. (Sec. 3)
6. Terminates the Program on July 1, 2028. (Sec. 3)
7. Allows DEMA to do the following:
a. Accept and spend money to carry out the Program.
b. Sell firearms, firearm accessories, ammunition and other equipment to promote marksmanship skills.
c. Contract with Arizona firearms manufacturers to manufacture or refurbish firearms and accessories for sale to participants in the Program.
i. Firearms manufactured or refurbished for sale must have the words "Arizona CMP" stamped on a central metallic part such as the receiver or frame.
d. Enter into agreements with public agencies or private entities to organize training courses, events and safety programs. (Sec. 3)
8. Establishes the Fund with proceeds from the sale of firearms, accessories and ammunition and private grants, gifts and contributions. (Sec. 3)
9. Requires DEMA to administer the Fund. (Sec. 3)
10. Defines particularly suited firearm or equipment. (Sec. 4)
11. Contains a conditional enactment clause. (Sec. 5)
12. Makes technical changes. (Sec. 1,2,4)
Current Law
A firearm that discharges two or more projectiles with one activation of the trigger or other firing device must be regulated under federal law (A.R.S. § 13-3114).
The state Militia consists of all able-bodied Arizona citizens between the ages of 18 and 45 years and all Arizona residents between 18 and 45 who have declared their intention to become citizens of the US (A.R.S. § 26-121).
Currently, any school district or charter school may offer an elective, one semester or one credit course in firearm marksmanship designated as the Arizona gun safety program course. A person who is currently certified as a firearms safety instructor by the Arizona Department of Game and Fish, the National Rifle Association, a federal, state or local law enforcement agency, a branch of the US military, a federal agency, the reserve officer training corps, the junior reserve officer training corps or the civilian marksmanship program is qualified to teach the Arizona gun safety program course (A.R.S. § 15-714.01).
