Provisions

1.       Exempts the APA from the Arizona Procurement Code. (Sec. 1)

Current Law

The APA is required to enter into contracts, rather than force accounts, for the construction of projects or facilities. For contracts exceeding $5,000, the APA must publish notice a minimum of 10 days before entering into the contract and award all contracts through a public bid to the lowest responsible bidder. In addition to construction contracts, purchases and contracts for material or services require advertisements in advance of opening bids to ensure appropriate notice and competition, with exceptions (A.R.S. § 30-128).

The Arizona Procurement Code, outlined in Title 41, Chapter 23 of the Arizona Revised Statutes, applies to expenditures of public monies through state governmental units, with exceptions. The State Procurement Office is a division of the ADOA, and serves as the central procurement authority for state agencies, boards and commissions (A.R.S. § 41-2511).
