Abstract

☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteRelating to reimbursement for the CD 8 special primary and general elections.

Provisions

1.       Appropriates a blank amount from the state GF in FY 2018 to the SOS for reimbursement to Maricopa County for expenses due to administering the special primary and general elections to fill the vacancy in CD 8.

2.       Requires the SOS to reimburse Maricopa County in whichever amount is less:

a.       the amount of the actual expenses, limited to the amount of the estimated cost for the two elections that were submitted to the SOS.

b.       $2.50 per active registered voter, for both elections, in Maricopa County as of January 1, 2018.

3.       Requires Maricopa County to submit its certified claims to the SOS.

4.       Prohibits the SOS from reimbursing the following:

a.       Regular pay and associated employer-related expenses for permanent county staff.

b.       Maintenance of infrastructure, machinery and equipment.

c.        Any expenditure not delineated as reimbursable in the State of Arizona Accounting Manual that is in effect on January 1, 2018.

5.       Requires the SOS to submit a report to JLBC and OSPB regarding the reimbursements.

6.       Exempts the appropriation from lapsing.

Current Law

A.R.S. § 16-222 requires the Governor to call a special primary and general election within 72 hours of a vacancy of a Congressional representative's office if the next general election is more than six months from the time of vacancy.

Additional Information

The Governor called for a special primary and general election to fill the vacancy in CD 8 on December 11, 2017.  The CD 8 special primary election will take place on February 27, 2018.  The special general election will take place April 24, 2018.
