Abstract

☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteRelating to ownership and control of public lands.

Provisions

1.       Directs the AG to analyze legal theories Arizona may pursue to attempt to gain ownership or control of public lands, including the:

a.       Equal Sovereignty Principle;

b.       Equal Footing Doctrine;

c.        Compact Theory; and

d.       Property Clause. (Sec. 1)

2.       Instructs the AG to submit a report of the above analysis to the President of the Senate and the Speaker of the House of Representatives by October 1, 2018. (Sec. 1)

3.       Permits the AG, after consultation with the President of the Senate and Speaker of the House of Representatives, to commence an action to attempt to gain ownership or control of public lands within Arizona. (Sec. 1)

4.       Contains a delayed repeal date of October 1, 2026. (Sec. 1)
