Relating to the filing of referenda applications and ballot measure expenditure reports.
Provisions
1. Prohibits the SOS from accepting an application for a statewide referendum against a Legislative enactment until adjournment of the Legislative Session. (Sec. 2)
2. Requires a PAC that makes expenditures in support or opposition of a statewide ballot measure to file a monthly campaign finance report covering the first month the PAC receives more than $25,000 in aggregate contributions.
a. Includes support or opposition to the circulation of a petition for the ballot measure. (Sec. 1)
3. Requires the PAC to file the monthly report on the fifth day of the month and requires the report to be complete through the last day of the preceding month. (Sec. 1)
4. Makes conforming changes. (Sec. 1)
Current Law
Campaign Finance Reports
An entity is required to register as a PAC if the entity is organized for the primary purpose of influencing the result of an election and the entity knowingly receives contributions or makes expenditures of at least $1,100 in connection with any election during a calendar year (A.R.S. §§ 16-905 & 16-931). PACs and political parties are required to file quarterly campaign finance reports for each calendar quarter without an election and pre-election and postelection reports for each calendar quarter with an election (A.R.S. § 16-927). Campaign finance reports are required to include:
· The amount of cash on hand at the beginning of the reporting period;
· Total receipts during the reporting period;
· An itemized list of all disbursements of more than $250 in specified categories during the reporting period;
· The total sum of all receipts and disbursements for the reporting period; and
· A certification by the committee treasurer that the contents of the report are true and correct (A.R.S. § 16-926).
Filing of Referenda Petitions
A person or entity filing a referendum petition against a measure must file an application and statement of organization with the SOS before printing and circulating the petition (A.R.S. § 19-111). All referendum petitions must be filed with the SOS no more than 90 days after the adjournment of the Legislative Session (Arizona Constitution, Article IV, § 1, Part 1).
