Abstract

Provisions

1.       Exempts authorized emergency vehicles IN USE BY A FIRST RESPONDER IN THE LINE OF DUTY from time and occupancy restrictions to drive in the HOV lane. (Sec. 1)

2.       Makes conforming changes. (Sec. 1)

Current Law

An authorized emergency vehicle is defined as any of the following:

1.       A fire department vehicle;

2.       A police vehicle;

3.       An ambulance or emergency vehicle that is designated or authorized by the department or a local authority; and

4.       Authorized ambulances, fire trucks and rescue vehicles that meet prescribed liability insurance requirements (A.R.S. §28-101).

Vehicles carrying only the driver and no passengers are not permitted to drive in the HOV lane during restricted times. Violators are subject to a $200 civil penalty, $100 of which is deposited into the GF. The following are exceptions:

1.       A tow truck being driven during the performance of the tow truck operator's duties;

2.       A motorcycle; and

3.       A public transportation vehicle (A.R.S. §28-737).
