Abstract

Provisions

1.       Directs the SOS or a county recorder to provide ADOT with a summary of a registrant's information for validating the residence address on a completed voter registration form.

a.       Requires the summary to include their full name, address, date of birth and driver license or nonoperating identification license number.  (Sec. 1)

2.       Requires ADOT to determine if a registrant's residence address on ADOT's records is the same as the address on the summary from SOS. (Sec. 2)

3.       Instructs ADOT to notify the registrant in writing, if the addresses are not the same, of the following:

a.       A provision stating that, within 30 days of the notice, if a registrant provides written evidence to ADOT that they have registered to vote using an address that is the same as the address in ADOT's records, the registrant is not subject to a civil penalty.

b.       A provision stating that, if the registrant does not provide evidence, the following will occur:

i.         The registrant will be subject to a civil penalty of 10% of $250; and

ii.       If the registrant does not update their address with ADOT within 10 days, they will be subject to a suspension of their driver license or nonoperating identification license.

c.        A copy of statutory language. (Sec. 2)

4.       Specifies that within 30 days after the notice date, the registrant must submit written evidence to ADOT that they are registered to vote using an address that is the same as the address in ADOT's records or the following will occur:

a.       The registrant will be subject to a civil penalty if 10% of $250.

b.       The registrant will be subject to a suspension of their driver license or nonoperating identification license (Sec. 2)

5.       States that within 30 days after the notification date, if a registrant fails to provide written evidence that they have registered to vote using the same address as the address on ADOT's records and fails to update within 10 days, ADOT must suspend the registrant's driver license and nonoperating identification license until the person provides the evidence. (Sec. 3)

Current Law

The form used for the registration of electors must contain: 1) the date the registrant signed the form; 2) the registrant's name, middle name, if any, and surname; 3) the complete address of the registrant's place of residence, including street name and number, apartment or space number, city or town and zip code; 4) the registrant's complete mailing address, if different from the residence address, including post office address, city or town, zip code or other designation used by the registrant for receiving mail. 

The form must also include a line for the registrant's e-mail address, the registrant's date of birth and one of the following: 1) the Arizona driver license number or nonoperating identification license number of the registrant; 2) the last four digits of the registrant's social security number; or 3) a social security number (A.R.S. § 16-152).

If a registrant's name or address changes after applying for or receiving a driver license or nonoperating identification license, they must notify ADOT within 10 days after the change of the old and new address or the former and new name and the following: 1) if a registration or title is applied for or received, the number of vehicles registered to the person and the vehicle identification numbers of the vehicles: 2) if a driver license or nonoperating identification license is applied for or received, the registrant's date of birth and the number of each license or a statement that each license is suspended, revoked or canceled.  A registrant should notify ADOT of an address or name change by telephone, written or in person notice or by approved electronic means.  A violation would result in a civil traffic violation. (A.R.S. § 28-448).

A civil penalty imposed cannot exceed $250 and the court will levy surcharges (A.R.S. § 28-1598).
