Relating to Health Regulatory Boards.
Provisions
Board of Behavioral Health Examiners (BBHE)
1. Requires BBHE to allow an applicant for licensure to take the examination 3 times in a 12-month period. (Sec. 2)
2. Stipulates that an academic review committee must provide a comprehensive written request for additional information if the committee determines that additional information is needed from an applicant. (Sec. 3)
3. Requires BBHE to waive an applicant's fee for an independent level license if the applicant paid an initial or renewal associate level license fee and applied for an independent level license within 90 days. (Sec. 4)
4. Permits required written communications or notices to be transmitted or received by mail, electronic transmission, fax or hand delivery.
a. Prohibits communications or notices from being transmitted or received orally. (Sec. 1)
Board of Massage Therapy (Board)
5. Specifies that an individual applying for reciprocal licensure must have been licensed in another state for at least two of the last five years, rather than continuously for five years. (Sec. 6)
6. Requires an applicant for reciprocal licensure to be licensed in another state that has comprehensive standards for massage therapists, rather than standards that are substantially equivalent. (Sec. 6)
7. Requires the Board to report to the Legislature on issues regarding the number of required hours necessary to demonstrate entry-level competence to practice massage therapy. (Sec. 7)
8. Requires the report to include:
a. A survey of requirements of businesses who have massage therapists;
b. Laws in Arizona and other states; and
c. Requirements of massage therapy organizations and accreditation entities. (Sec. 7)
9. Repeals reporting requirements on July 1, 2019. (Sec. 7)
Board of Homeopathic and Integrated Medicine Examiners, State Board of Dispensing Opticians and Board of Behavioral Health Examiners (Boards)
10. Requires the Boards to research and compare other state's licensing requirements for health professionals. (Sec. 8)
11. Requires the Boards to make recommendations regarding:
a. The reduction of administrative burdens; and
b. Streamlining of the licensure process and reducing licensure costs. (Sec. 8)
12. States that the Boards must submit a report of its findings and recommendations to members of the Legislature and the Executive branch by January 1, 2019. (Sec. 8)
13. Contains a repeal date of July 1, 2019. (Sec. 8)
Miscellaneous
14. Makes technical and conforming changes. (Sec. 1-5)
Current Law
The BBHE is required to establish Academic Review Committees for each professional area that they license. Academic Review Committees are tasked with reviewing, under specified circumstances, applications to determine an applicant's compliance with educational requirements, making recommendations regarding required work experience requirements and making findings concerning an application's deficiencies. Academic Review Committees make various other recommendations to the BBHE relating to curriculum and examinations (A.R.S. § 32-3261).
Applicants for reciprocal licensure as a massage therapist must have been continuously licensed in another state at least five years prior to applying for a reciprocal license. The other state must have standards that are substantially equivalent to Arizona's (A.R.S § 32-4223).
