Relating to PDD.
Provisions
1. Allows a local authority to adopt restrictions for the safe operation of PDDs. (Sec. 2)
2. Defines a personal delivery device as an electronically powered device that is:
a. Primarily operated on sidewalks and within crosswalks;
b. Operated at a maximum speed of 7 mph with a weight of less than 200 pounds, excluding cargo; and
c. Equipped with technology to operate with or without the active control or monitoring of a person and a braking system that comes to a controlled stop. (Sec. 1)
3. Allows operation of a PDD on sidewalks, within crosswalks and roadways.
a. Requires a PDD operated on a roadway to travel at a maximum speed of 25 mph and as far to the right as practicable. (Sec. 3-4)
4. Stipulates a PDD has all the applicable rights and duties of pedestrians. (Sec. 4)
5. Requires an owner and operator of a PDD to maintain an insurance policy that provides general liability coverage of at least $100,000 for damages. (Sec. 4)
6. Excludes PDD from the definitions of a motor vehicle and vehicle. (Sec. 1)
7. Excludes PDDs from registration and motor vehicle insurance requirements. (Sec. 5-6)
8. Allows a local authority to:
a. Permit a PDD to exceed maximum speed and weight restrictions.
b. Allow an owner and operator of a PDD to maintain an insurance policy that provides less than $100,000 for damages. (Sec. 2)
9. Contains a repeal date of September 1, 2020. (Sec. 7-8)
10. Makes technical and conforming changes. (Sec. 1, 5)
