Relating to child abuse prevention
education & training.
Provisions
1. Instructs LEAs to establish education and training on child abuse prevention for school personnel who are mandatory reporters and students, beginning in SY 2019. (Sec. 1)
2. Requires LEAs to provide the training and education:
a. At least once per year for students;
i. Parents may opt their children out of the instruction.
b. During orientation for all new school personnel who are mandatory reporters; and
c. On a schedule adopted by the LEA for all existing employees. (Sec. 1)
3. Authorizes LEAs to develop their own training or use a curriculum approved by SBE. (Sec. 1)
4. Directs SBE to approve and maintain a list of approved curricula for the required training and outlines curricular requirements. SBE must try to include:
a. As many options as possible that require up to 3 hours of instructional time; and
b. At least one option delivered through online instruction. (Sec. 1)
5. Requires signs for reporting emergencies, abuse or neglect be placed in each school and provides content, size and placement requirements. (Sec. 1)
6. Exempts teachers and administrators from the training requirement if they:
a. Completed a child abuse or sexual abuse prevention and training program in that SY; or
b. Received training regarding the duty to report during that SY. (Sec. 1)
7. Outlines the requirements for the education and training and allows LEAs to choose the delivery method for the instruction. (Sec. 1)
8. Allows LEAs to pay for the cost of the training and curriculum or enter agreements with a qualifying community organization to provide the training at no cost. (Sec. 1)
9. Permits LEAs to use grant monies from any available federal source, including ESSA, for the program requirements. (Sec. 1)
10. Asserts that the required instruction does not require sex education instruction, void or impair any right guaranteed to parents or limit or impair immunity for school personnel. (Sec. 1)
11. Instructs LEAs to include a description of the child abuse prevention education and training in an informational handbook or on their website. (Sec. 1)
12. Authorizes a parent or guardian of a minor student review the materials for the education and training program after making a written request to the school principal. (Sec. 1)
