Relating to school buildings near airports.
Provisions
1. Requires a charter school or school district seeking to locate a school within two miles of a public use airport runway to obtain a determination of no hazard from the FAA before commencing construction. (Sec. 1)
2. Exempts a charter school or district school that exists within two miles of a public use airport runway as of January 1, 2015, unless the charter school seeks to build a new structure. (Sec. 1)
3. Contains a delayed effective date of September 1, 2018. (Sec. 2)
Additional Information
The FAA conducts an aeronautical study when requested by the sponsor of any proposed construction or alteration, or if it deems a study is necessary. The study is conducted to determine the impact of a proposed structure or alteration on aeronautical operations, procedures and the safety of flight. The FAA issues a determination stating whether certain proposed constructions or alterations would be a hazard to air navigation and makes the determinations based on the aeronautical study findings. The FAA issues either a determination of hazard or a determination of no hazard. A determination of no hazard is issued when the study concludes that the proposed construction or alteration will exceed an obstruction standard, but would not have a substantial impact to air navigation and may include: 1) conditional provisions of a determination; 2) limitations necessary to minimize potential problems; 3) supplemental notice requirements; and 4) marking and lighting recommendations (14 CFR, Part 77(D)).
