Abstract

Provisions

1.       Requires a person to receive approval by the governing body of a municipality in order display or otherwise employ any copy or resemblance of a municipal seal. (Sec. 1)

2.       Permits the governing body of a municipality to grant a certificate of approval for any person who shows a good cause to use a municipal seal for a proper purpose. (Sec. 1)

3.       Permits a municipality to adopt rules for the use of municipal seals. (Sec. 1)

4.       Prohibits any person other than a municipal department from using the seal for the advertisement or promotion of sale of any article of merchandise or other commercial process. (Sec. 1)

5.       Requires the governing body of a municipality to issue a cease and desist order to anyone who uses a municipal seal without the approval of a municipal governing body.

a.       Classifies a failure to comply with the order as a Class 3 misdemeanor (30 days/$500 plus surcharges). (Sec. 1)

6.       Stipulates that if a municipality maintains a website, it must display the adopted seal and the text prohibiting the improper use of the seal. (Sec. 1)
