Relating to electric bicycles.
Provisions
1. Defines electric bicycle as a bicycle or tricycle with fully operable pedals and an electric motor and is classified as one of the following:
a. Class 1 electric bicycle contains a motor that provides assistance when the rider pedals and ceases when the electric bicycle reaches 20 mph;
b. Class 2 electric bicycle contains a motor that may exclusively be used to propel the electric bicycle and ceases when the electric bicycle reaches 20 mph; or
c. Class 3 electric bicycle contains a motor that provides assistance when the rider pedals and ceases when the electric bicycle reaches 28 mph. (Sec. 1)
2. Stipulates that an operator of an electric bicycle is subject to the same provisions, privileges, and duties as a person riding a bicycle, except as otherwise provided. (Sec. 2)
3. Exempts electric bicycles from requirements relating to certificates of title, registration, vehicle license tax, driver licenses and vehicle insurance. (Sec. 2)
4. Requires that, beginning on January 1, 2019, electric bicycle manufacturers and distributors apply a permanent label containing the classification number, top assisted speed and motor wattage in at least nine-point type on each electric bicycle. (Sec. 2)
5. Permits Class 1 electric bicycles and Class 2 electric bicycles to be used on bicycle and multiuse paths, unless operation of an electric bicycle is prohibited by a local authority or agency with jurisdiction over the path. (Sec. 2)
6. Prohibits Class 3 electric bicycles from being operated on a bicycle or multiuse path, unless the path is adjacent to a highway or roadway or the local authority or agency with jurisdiction over the path permits operation. (Sec. 2.)
7. Removes electric bicycle from the section pertaining to motorized gas powered bicycles or tricycles. (Sec. 3)
8. Modifies the definitions of motorized gas powered bicycles or tricycles, moped, motorcycle, motor driven cycle, motor vehicle, and vehicle to exclude electric bicycle. (Sec. 1, 3)
9. Contains conforming changes. (Sec. 1)
Current Law
Motorized electric and gas powered bicycles and tricycles are permitted to use the rights-of-way designated for bicycles and are exempt from Chapter 9, which concerns vehicle insurance and financial responsibility. Local authorities are permitted to adopt any ordinance to regulate or prohibit the operation of electric or gas powered bicycles or tricycles that does not require their registration and licensing.
A motorized electric or gas powered bicycle or tricycle is defined as a bicycle or tricycle equipped with a helper motor with a maximum piston displacement of 48 cm3 or less and is operated at speeds of less than 20 mph.
Motorized electric and gas powered bicycles and tricycles do not require any of the following:
1. Certificate of title;
2. Registration;
3. Vehicle license tax;
4. Required equipment for motorcycles and motor-driven cycles as required by section 28-964;
5. Vehicle emissions inspections; or
6. Driver license (A.R.S. §28-2516).
