Relating to US Senate elections.
Provisions
1. Directs each party caucus from both chambers of the Legislature, after holding a public meeting to consider potential candidates, to meet separately and designate by majority vote two nominees for each party to appear on the general election ballot for US Senator.
2. Requires, in a vacancy for a US Senator, that candidates on the general election ballot be designated by the legislative nomination process, rather than a primary election.
3. Directs the SOS to submit this proposition to the voters at the next general election.
Current Law
The State Constitution requires primary elections for the nomination of candidates of all elective state, county and city offices, including candidates for US Senate and House of Representatives (Arizona Constitution, Article VII, Section 10). Primary elections must be held on the 10th Tuesday prior to a general or special election when candidates for public office are to be elected (A.R.S. § 16-201).
When there is a vacancy for the office of US Senator through resignation or any other cause, a primary and general election must provide for nomination and election of a candidate (Arizona Constitution, Article VII, Section 17). The person elected will fill the unexpired term of the vacated office. The Governor is required to appoint a person, of the same political party of the person vacating office, to serve until the person elected at the next general election is qualified and assumes office (A.R.S. § 16-222).
