Relating to commercial vehicle border crossing fees.
Provisions
1. Allows the Director to establish a fee on the number of axles attached to a commercial vehicle or commercial vehicle combination entering a county with a population of less than 190,000 people or more than 250,000 people from Mexico. (Sec. 1)
2. Removes the stipulation that the vehicle operator must be a nonresident to be required to pay the fee. (Sec. 1)
3. Instructs the Director to deposit the collected fees into the State Highway Fund instead of SETIF. (Sec. 1)
4. Stipulates that monies deposited into the State Highway Fund from commercial vehicle axle and excess weight permit fees be used only for transportation facilities within 20 miles of the port of entry.
a. Requires ADOT to proportionally spend monies received from ports of entry used by commercial vehicles and commercial combination vehicles to enter the state. (Sec. 4)
5. Defines commercial vehicle, commercial combination vehicle and transportation facilities. (Sec. 4)
6. Contains a retroactive effective date of July 1, 2018. (Sec. 5)
7. Makes technical and conforming changes. (Sec. 1-3)
Current Law
The Director may adopt rules to establish a fee on the number of axles attached to a foreign vehicle or foreign combination vehicle that is operated by a nonresident and entering the state from Mexico. All funds received from the fee are deposited into SETIF. A foreign vehicle or foreign combination vehicle is defined as a truck or truck tractor and semitrailer that is registered or under the jurisdiction of a foreign country and enters the state from Mexico in the furtherance of a commercial enterprise (A.R.S. §28-5474).
Monies deposited into SETIF are spent on developing and maintaining safe highway conditions relating to the Arizona and Mexico border and collecting international trade data (A.R.S. §28-6547).
