Abstract

Provisions

1.       Provides that custom orthotic or prosthetic device requirements do not:

a.       Restrict a licensed health care provider from prescribing a custom orthotic or prosthetic device if the device is molded, fabricated and fitted by an authorized provider; or

b.       Prevent a licensed health care provider that does not meet statutory requirements from providing licensed services if they don't receive an insurance payment or reimbursement for a custom device. (Sec. 1)

2.       Makes technical and conforming changes. (Sec. 1)

Current Law

A custom orthotic or custom prosthetic device must meet the following requirements:

·         Be provided by a fabricator or supplier that is accredited by an independent accreditation organization approved by the Secretary of the United States Department of Health and Human Services;

·         Be provided by a qualified practitioner under federal law or licensed as a podiatrist, medical doctor, osteopathic physician, physical therapist, physician assistant or occupational therapist; and

·         Have a valid prescription for the custom orthotic or custom prosthetic device.

If the health care provider does not receive an insurance payment because the custom orthotic or custom prosthetic device does not meet statutory requirements, the health care provider may not attempt to collect payment or reimbursement from the patient. (A.R.S. § 36-2411)
