Relating to the District board of directors.
Provisions
1. Allows a District that includes more than 10,000 acres of land and has five board members to do the following by resolution:
a. provide for the election of an additional qualified elector from each division; and
b. reduce the board membership from two directors at large to one. (Sec. 1)
i. Eliminates the position of the director at large whose terms expires next. (Sec. 1)
2. Staggers the terms of the board of director so no more than one director from each division is elected in any year. (Sec. 1)
Current Law
A District is organized to develop irrigation infrastructure for the land owners in the area (A.R.S. § 48-2901). A District is formed when a majority of resident owners of real property in an area sign a petition and file it with the county BOS. After a hearing and approval, the District is divided into three divisions and a director is elected for each division (A.R.S. §§ 48-2905, 48-2913).
A District with more than 10,000 acres of land may elect two qualified electors as directors at large in addition to the directors elected from each division in the District (A.R.S. § 48-2914.01). The term for a director is three years (A.R.S. § 48-3011).
