Relating to secure entrances for registered nonprofit medical marijuana dispensaries.
Provisions
1. Requires registered nonprofit medical marijuana dispensaries to have at least one secure entrance, rather than a single secure entrance. (Sec. 1)
2. Requires ADHS to adopt rules to address the use of secure entrances by registered nonprofit medical marijuana dispensaries.
a. Exempts ADHS from rulemaking requirements for one year to adopt the rules. (Sec. 2)
Current Law
Nonprofit medical marijuana dispensaries are required to register with ADHS to operate (A.R.S § 36-2804). Registered nonprofit medical marijuana dispensaries are required to be operated on a not-for profit basis and are prohibited from acquiring, processing, cultivating or dispensing marijuana for any purpose except to assist registered qualifying patients with medical use of marijuana. These dispensaries are required to have a single secure entrance and implement appropriate security measures in order to deter and prevent theft of marijuana and unauthorized entrance into areas containing marijuana. The dispensaries are subject to reasonable inspection by ADHS (A.R.S. § 36-2806). Additionally, ADHS is required to adopt rules governing dispensaries for the purpose of protecting against diversion or theft, including minimum security requirements (A.R.S. § 36-2803).
