Abstract

Provisions

1.       Lists the individuals and information required on the license application for the various company make-ups, including the addition of an LLC. (Sec. 2)

2.       Conforms the notice given to the Registrar when there is a transfer in ownership of 25% or more of the stock or beneficial interest in the business to the initial listing of all owners of 25% or more. (Sec. 3)

3.       Rewrites and modifies the provision requiring payment of all civil penalty monies resulting from an act or omission assessed against a contractor before a new license is issued to anyone named on the contractor's license. (Sec. 4)

4.       Revises and adopts defined terms as follows:

a.       Named on a license is the name required to be identified by law.

b.       Person means a company, partnership, firm, association, trust, society or natural person in                                                            addition to a corporation. (Sec. 1)

5.     Rewrites and updates the statutory language for license applications. (1-4)

6.     Makes technical and conforming changes. (Sec. 1-4) 

Current Law

A.R.S. § 32-1122 lists the qualifications for a contractor's license, including the requirement to list the classification of the license being sought, and depending on the business make-up, list the names, addresses, and officers of the company including owners with 25% or more of the stock or interest in the company. Further, statute requires naming the qualifying party, providing proof of workers' compensation coverage and whether the company is in good standing with the Arizona Corporation Commission. An applicant must notify the Registrar of any changes within 30 days.

A.R.S. § 32-1151.01 requires notice be given immediately to the Registrar when a corporation, association or other organization that is a licensed contractor and has a transfer in ownership of 50% or more of the stock or beneficial interest in the business.
