Relating to the renaming and organization of HRCs.
Provisions
1. Renames HRCs into IOCs. (Sec 5, 6, 8 & 9)
2. Places the IOCs under ADOA, instead of ADES, AHCCCS and DCS. (Sec 6, 8-9)
3. Limits the number of current or former providers who can serve on each IOC on the mentally ill to two per committee. (Sec 9)
4. Makes technical and conforming changes. (Sec. 1-4, 6-10)
Current Law
Laws 2000, Chapter 261 established the:
· HRC on persons with developmental disabilities (DDDHRC) under ADES;
· HRC on children, youth and families under DCS; and the
· HRC on the mentally ill under AHCCCS.
A.A.C. R9-21-105 requires AHCCCS to establish an HRC for each region (Northern, Southern and Maricopa), along with an HRC for the ASH.
Each committee is required to meet at least quarterly to provide independent oversight to ensure clients' rights are protected, review incidents and provide recommendations to the appropriate director and the Legislature. Health care entities are permitted to disclose information to HRCs without personally identifiable information unless the personally identifiable information is required for the official purpose of the committee. HRCs are required to maintain case information as confidential, a violation of confidentiality is a Class 2 misdemeanor (4 months/ $750 plus surcharges) (A.R.S. §§ 36-509 and 41- 3804).
