Provisions

1.       Urges the United States Congress to pass the NWFA.

Current Law

The NWFA, consisting of two concurrent U.S. federal bills, S.551 and H.R.1410, is an effort by Arizona congressional representatives to direct the City of Nogales, Arizona, to contribute an equitable portion of the costs towards the operation and maintenance of the NSP based on the average daily volume of wastewater originating from the City.

U.S. Code Title 22-277d-10 prohibits the U.S. Secretary of State from entering into an agreement with Mexican officials for the operation and maintenance of the NSP until the city of Nogales, Arizona has demonstrated it will contribute an equitable proportion of operation and maintenance costs allocated to the United States.

Additional Information

The NIWTP is managed by the IBWC, a binational cooperative organization administered by the United States and Mexico. The NIWTP treats wastewater for both Nogales, Arizona, and Nogales, Sonora. The plant treats a daily average of approximately 15 million gallons of wastewater, 80% of which originates from Mexico. Average yearly operation and maintenance costs total about $4.5 million, with costs funded by Mexico, the United States Congress, and Nogales, AZ based on flow contributions from each country.

 

The NSP is authorized by U.S. code and includes the IOI and the NIWTP.
