Abstract

Provisions

1.       Urges Congress to:

a.       pass the NWFA; and

b.       address the border sanitation problems resulting from the inadequate maintenance of the Naco, Sonora wastewater treatment facility.  (Sec. 1)

Current Law

The NWFA, consisting of two concurrent U.S. federal bills, S.551 and H.R.1410, is an effort by Arizona congressional representatives to direct the City of Nogales, Arizona, to contribute an equitable portion of the costs towards the operation and maintenance of the NSP based on the average daily volume of wastewater originating from the City.

U.S. Code Title 22-277d-10 prohibits the U.S. Secretary of State from entering into an agreement with Mexican officials for the operation and maintenance of the NSP until the city of Nogales, Arizona has demonstrated it will contribute an equitable proportion of operation and maintenance costs allocated to the U.S.

Additional Information

The NIWTP is managed by the IBWC, a binational cooperative organization administered by the U.S. and Mexico. The NIWTP treats wastewater for both Nogales, Arizona, and Nogales, Sonora. The plant treats a daily average of approximately 15 million gallons of wastewater, 80% of which originates from Mexico. Average yearly operation and maintenance costs total about $4.5 million, with costs funded by Mexico, the U.S. Congress, and Nogales, AZ based on flow contributions from each country.

The NSP is authorized by U.S. code and includes the IOI and the NIWTP.

For years, sewage has been overflowing from the Naco, Sonora wastewater treatment plant from Mexico across the border into the city of Naco, Arizona, posing public health hazards to residents.
