Relating to an amendment to the Constitution regarding expenditures required by initiative.
Provisions
1. Repeals initiatives 10 years after its effective date if the initiative proposed mandatory expenditures of state revenues and provided an increased source of revenue to cover the proposal.
a. Does not apply if the initiative had a repeal date earlier than 10 years.
2. Directs the SOS to submit this proposition to the voters at the next general election.
Current Law
Article IX, Section 23 of the Arizona Constitution requires all initiatives and referendums that expend state revenues, establish a fund or allocate funding for any specific purpose to identify a source that would cover all immediate and future expenditures for that proposal. Increased revenues needed for the proposal are prohibited from being derived from the GF or reduce GF revenues. If the identified revenue source fails to fund the entire mandated expenditure for any FY, the Legislature can reduce the expenditure of state revenues for that program to the amount provided by the revenue source.

Proposition 101, amending the Constitution to add Article IX, Section 23, was referred to the voters by the Legislature in 2004 (HCR 2022).
