state land sales; payment method
Purpose
Allows purchasers of state land to use any form of payment approved by the State Land Commissioner (Commissioner).
Background
The State Land Department (SLD) oversees approximately 9.2 million acres of state trust land, as well as the natural products derived from the land. The SLD purpose is to manage the trust land and maximize revenues for its 13 beneficiaries, the largest of which is K-12 schools.
Statute allows the Commissioner to impose application and administrative fees. The Commissioner may accept payment for these fees in the form of credit and charge cards, debit cards and electronic transfers (A.R.S. §§ 37-107 & 37-109).
Statute defines state land as any land owned or held in trust, or otherwise, by the state. Current law prohibits the Commissioner from accepting forms of payment other than cashier's check for the purchase of state land (A.R.S. §§ 37-101 & 37-241).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows the Commissioner to accept alternative forms of payment in addition to cashier's checks for state land sales.
2. Makes technical and conforming changes.
3. Becomes effective on the general effective date.
