Purpose
Specifies that a licensed healthcare provider is not restricted from issuing a prescription for a custom orthotic or prosthetic pursuant to applicable state law.
Background
A custom orthotic device or custom prosthetic device is an orthotic or prosthetic device that is individually fabricated for a patient over a positive mold, a tracing or a scan of the patient and does not include shoes and shoe inserts, dental devices, hearing-related devices or the replacement of all or part of an internal body organ (ARS § 36-2411).
Statute requires that custom orthotic or prosthetic devices furnished to an individual meet the following criteria: 1) be provided by a fabricator or supplier that is accredited by an independent accreditation organization approved by the Secretary of the U.S. Department of Health and Human Services, as outlined; 2) be provided by a health care provider that is a qualified practitioner as outlined in federal law or a licensed podiatrist, medical doctor, osteopathic physician, physical therapist, physician assistant or occupational therapist; and 3) have a valid prescription for the custom orthotic or prosthetic device (ARS § 36-2411).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. States that a licensed healthcare provider is not restricted from issuing a prescription for a custom orthotic or prosthetic pursuant to applicable state law.
2. Make a technical change.
3. Becomes effective on the general effective date.
