Purpose
Requires a law enforcement agency to review evidence before a photo enforcement system citation is issued.
Background
A photo enforcement system is a device consisting of a radar unit or sensor linked to a recording device that produces recorded images of a vehicle's license plate for the purpose of identifying violators of traffic signs, signals and markings, or speed restrictions in this state (A.R.S. § 28-601).
Current statute allows local authorities and state agencies to use a photo enforcement system if outlined statutory standards and specifications are adopted indicating that a photo enforcement system is present and operational. If the standards and specifications are not met, the court may dismiss any citation issued to a person identified using a photo enforcement system (A.R.S. § 28-1204).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires a law enforcement agency to review recorded evidence and determine whether a violation occurred before issuing a citation resulting from a violation identified by a photo enforcement system.
2. Prohibits a photo enforcement company from determining violation for the purposes of a citation and classifies the penalty as a class 1 misdemeanor.
