silver alert notification; developmental disability

 

Purpose

 

Allows a Silver Alert to be issued for a missing person with a developmental disability.

 

Background

 

Laws 2014, Chapter 232 established the Silver Alert Notification System (Silver Alert), allowing the Department of Public Safety (DPS) to issue quick response alerts for missing persons ages 65 or older. Laws 2016, Chapter 146 added Alzheimer's disease and dementia to conditions triggering a Silver Alert. After exhausting available resources, a law enforcement agency may request issuance of a Silver Alert for a qualifying person that is missing under suspicious circumstances and believed to be in danger (A.R.S. § 41-1728).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Allows DPS to issue a Silver Alert on request of a law enforcement agency investigating a report of a missing person with a developmental disability.

 

2.      Defines developmental disability as a severe, chronic disability that is caused by cerebral palsy, epilepsy, autism or a cognitive disability.

 

3.      Becomes effective on the general effective date.
