DES; fingerprint card; tax information
Purpose
Requires employees and contractors in internet technology (IT), who have access to federal tax information at the Department of Economic Security (DES), to obtain a valid fingerprint clearance card.
Background
Currently, DES requires each employee who is employed in an IT position to have a valid fingerprint clearance card. Before accepting an offer of employment, an applicant for an IT position at DES must have a valid fingerprint clearance card issued or provide documentation of the person's application for a fingerprint clearance card. DES is prohibited from disclosing information obtained from the fingerprint clearance card except to staff members of DES for employment purposes (ARS § 41-1969).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires that each employee or contractor of DES who has access to federal tax information obtain a valid fingerprint clearance card.
2. Requires that each employee and contractor in IT at DES certify on a notarized form that the person is not awaiting trial on or has not been convicted of any criminal offenses requiring them to register as a sex offender in any state.
3. Defines federal tax information.
4. Becomes effective on the general effective date.
