FACT SHEET FOR S.B. 1167

 

veterans; increased income tax subtraction

(NOW: merit council; law enforcement qualifications)

 

            As passed by the Senate, S.B. 1167 increases the allowable state income tax subtraction for retainer and retirement benefits, annuity and pension pay from the Uniformed Services of the United States.

 

            The House of Representatives adopted a strike-everything amendment that does the following:

 

Purpose

 

Modifies the powers and duties of merit system councils (councils) for law enforcement officers.

 

Background

 

Current law requires specified counties, cities or towns to have five-member councils, with members appointed by the jurisdiction's governing body (A.R.S. § 38-1002). Statute outlines the duties of councils relating to law enforcement officers, including: 1) classifying all positions occupied by law enforcement officers; 2) recommending schedules of salary and other compensation; 3) fixing and refixing standards and qualifications for positions; and 4) providing a plan for promotion (A.R.S. § 38-1003).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Requires councils, from time to time, to:

a)      review, instead of fix and refix, standards and qualifications for positions and recommend any changes to the human resources director;

b)      classify positions and recommend salary schedules, on recommendation from the department head; and

c)      provide, in consultation with the department head, a plan for fair and impartial selection, appointment, retention, separation or removal from service.

 

2.      Requires councils to provide a plan of recommendations for promotions.

 

3.      Makes technical and conforming changes.

 

4.      Becomes effective on the general effective date.
