SUBJECT:      Strike everything amendment to S.B. 1182, relating to irrigation and water conservation districts; membership

Purpose

 

Modifies irrigation and water conservation districts (Districts) board membership.

 

Background

 

A District is a special taxing district organized to provide for irrigation infrastructure (ditches, canals, waterways and pumping plants). Statute allows Districts to be organized by a majority of land owners in a designated area (A.R.S.§48-2901). For election purposes, Districts are divided into separate divisions. Each Division is required to be as nearly equal in size as practicable  (A.R.S. § 48-2913).

 

            Current statute allows Districts with more than 10,000 acres of land to have three board members, one from each division and two directors at large.

 

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Allows Districts with more than 10,000 acres of land and five board members to modify the composition of the board as follows:

a)      elect one additional director from each division; and

b)      reduce, from two to one, the number of at large directors for a District and to provide for transition after the expiration of existing terms.

 

2.      Requires member's terms to be staggered so that no more than one director from each division is elected in one year.

 

3.      Becomes effective on the general effective date.

 

Amendments Adopted by Committee

 

1.      Adopted the strike everything amendment.

 

2.      Clarifies the circumstance whereby the number of at large directors is reduced from two to one.
