border security trust fund; repeal
Purpose
Repeals the Border Security Trust Fund (Fund).
Background
Established by Laws 2010, Chapter 211, the Joint Border Security Advisory Committee (Committee) was created for the purposes of: 1) taking testimony and other evidence regarding the international border with Mexico; 2) analyzing border crossing statistics; 3) analyzing related crime statistics; 4) making recommendations designed to increase border security; 5) administering and managing the construction and maintenance of the physical or virtual border fence, using technology to the maximum extent practicable; and 6) making other recommendations deemed essential by the Committee (A.R.S. § 41-113).
In its 2015 meeting, the Committee authorized the State Treasurer to disburse $219,211.87 from the Fund to the Cochise County Sheriff's Office (Office) for the purposes of enhancing Border Security. In 2016, the Office gave a presentation to the Committee providing an update on the progress of developing a virtual fence and how the initial disbursement of Fund monies was being allocated to enhance border security.
The Committee last met on December 12, 2017, where a motion was made authorizing the State Treasurer to disburse the amount of $55,633.94 from the Fund to the Office for the purpose of enhancing border security as specified in the Office's request letter dated December 4, 2017. With all of the monies in the Fund disbursed, the Committee approved a motion to recommend repealing the Fund.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Repeals the Fund.
2. Contains a legislative intent clause.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
