Purpose

 

Requires a seller of real property to give written notice to a buyer informing them of household products that may require special disposal.

 

Background

 

Current law outlines responsibilities for an owner of real property to provide written notice disclosing certain information about the property to the buyer prior to transferring ownership (A.R.S. § 33-434.01).

 

Statute defines lead acid battery as a battery with a core of elemental lead and a capacity of six or more volts that is suitable for use in a vehicle or a boat (A.R.S. § 44-1321).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.   Requires an owner of real property to provide written notice to the purchaser before transferring

     ownership stating:

a)      certain common household products may contain toxic chemicals that require special disposal; and

b)      the buyer may contact a city, town or county environment department for information on how to safely dispose of or recycle these products.

 

2.  Exempts the initial transfer of real property made pursuant to a construction contract from the        

     notice requirement.

 

3.  Becomes effective on the general effective date.
